Intervention of the United Nations Must for Peace In Kashmir

New York, October 1, 2017. In a memorandum submitted to Mr. Antonio Guterres, the Secretary General of the United Nations, Dr. Ghulam Nabi Fai, Secretary General, World Kashmir Awareness Forum and Barrister Sultan Mehmood Choudhary, former Prime Minister of Azad Kashmir highlighted the following:

We are writing to urge a leadership role of the United Nations in resolving the 70-year-old Kashmir conflict that has inflicted pain, agony, and injustice on a scale that makes East Timor, and Southern Sudan pale in comparison: more than 100,000 killings in the past two decade alone, and routine rape, torture, mutilation, plunder, disappearances, arbitrary detentions, and ruthless punishment of peaceful political dissent.

Kashmir conflict is perhaps the most dangerous conflict in the world because of the spiraling nuclear and missile race between India and Pakistan coupled with historical enmities that have occasioned three wars between the two rivals. It is implausible to believe that these two neighboring countries will either cap or renounce their respective nuclear genies after they have escaped the South Asian bottle unless the chief source of antagonism between the two — Kashmir — is resolved. It is obvious that no settlement can last if it is not based on justice for the people of Kashmir and recognition of their inherent rights.

It is also undeniable that the past 70 years have proven that bilateral India-Pakistan negotiations to resolve Kashmir conflict are simply charades that achieve nothing but more strife and horror stories in Kashmir. A new negotiating formula is thus urgently required both in the name of international peace, security and human rights. The element that has been missing in efforts towards a settlement is the political representation of Kashmiris on the negotiating table along with India and Pakistan. The All Parties Hurriyet Conference (APHC) that represents the broader spectrum of the opinion of the Kashmiri people is unswervingly devoted to a peaceful settlement of the Kashmir dispute, and is eager to explore constructive approaches to jump-starting the longstanding Kashmir stalemate that has ensued when the problem has been perceived as bilateral, to the exclusion of the 20 million Kashmiri people. As Northern Ireland required the participation of Sinn Fein in negotiations to succeed, Kashmir is no different.

We completely endorse the statement of the United Nations High Commissioner on Human Rights who expressed serious concern about the situation in Kashmir and proposed on September 13, 2016 that ‘an independent, impartial and international mission is now needed crucially and that it should be given free and complete access to establish an objective assessment of the claims made by the two sides.’

We trust that your personal involvement in this matter will bring its influence to bear on both India and Pakistan to initiate a peaceful negotiations with which the United Nations as well as the genuine leadership of the people of Jammu & Kashmir will be associated so as to ensure that settlement arrived at will be based on the principles of justice.

We place the trust in the statesmanship of the Excellency, as the Secretary General of the United Nations that you will not countenance any attempt to ignore the wishes of the people of the State of Jammu and Kashmir and bypass the expression of those wishes.

    Kashmiri Americans Observed July 13th As the Martyrs Day: Dr. Fai

    Washington, D.C. July 13, 2014. The Kashmiri Americans join the worldwide Kashmiri community to observe “Martyr’s Day”, in memory of 22 Kashmiris killed by Dogra troops on this day in 1931.     Fai expressed concern over the on going tragic situation in Kashmir because all available evidence testifies that human rights violations are systematic, deliberate, and officially sanctioned. India has given its forces powers to shoot to kill and the license to abuse the people in whatever ways they like in order to suppress the popular movement for basic human rights and self-determination.

    He emphasized, ‘India trembles at any attempt to resolve the Kashmir crisis because she is frightened by its outcome.’ When a former Defense Minister, Krishna Menon, was questioned as to why India would never hold a free self-determination election in Kashmir, he confessed that all of India’s political leaders knew it would lose. And would 700,000 soldiers be needed in Kashmir if the main opponents to India’s occupation were but a handful of outside “extremists”? The question answers itself.

    Dr. Fai Addressed a Forum of Journalists in Washington

    WASHINGTON, D.C. June 27, 2012 (APP): Jammu and Kashmir is an internationally recognized disputed territory and has never been an integral part of India, a veteran Kashmiri leader said.

    “I want to debunk this myth created by India that Kashmir is an integral part of India —- this is a matter of historical record that India occupied the region on October 27, 1947 when the very first Indian soldier set foot on the soil of Kashmir —- the highest diplomatic forums including the United Nations and the United States have recognized the disputed nature of the region,” Dr Ghulam Nabi Fai told a forum of journalists in Springfield, Virginia.

    The Kashmiri-American activist said in the post-9/11 world, New Delhi has tried to weave a smokescreen with some unfounded myths, which seek to discredit the genuine struggle of the people. But these ploys will never be able to cover up the reality and sufferings of people in the Occupied Kashmir, he added.

    “India has failingly tried to equate Kashmiri people with terrorists — how can a people, who believe in the UN-mandated right to self-determination and then hold demonstrations to go to the UN office in Srinagar to remind the international community of its pledge, be terrorists? Terrorists don’t believe in the UN system or any other global forum.

    “Also, how can an entire population of millions be dubbed as terrorists when they hold peaceful demonstrations for their promised rights?” he questioned.

    Dr. Fai also said that India would like you to believe that Kashmir is an issue of fundamentalism. He explained that “the term fundamentalism is quite inapplicable to the Kashmiri society. One of the proud distinctions of Kashmir has been the sustained tradition of tolerance and amity between the members of different religious communities. It has a long tradition of moderation and non-violence. Its culture does not generate extremism or fundamentalism. The fact is that Kashmir conflict was never a fight between Hindus and Muslims. It was never a struggle between theocracy and secularism. Nor was it a border dispute between India and Pakistan. It has always been about the hopes and future of 17 million people of Kashmir, be they Muslims, Hindus, Sikhs or Buddhists.”

    Universality of Human Rights: Myth or Reality

    No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.” Article 5, Universal Declaration of Human Rights

    The statement of Mr. Ban Ki-moon – UN Secretary General deserves an appreciation who wants to console people by saying: “On Human Rights Day, let us recommit to guaranteeing the fundamental freedoms and protecting the human rights of all.”

    The 1948 United Nations Universal Declaration of Human Rights (UDHR) on its 68th anniversary needs to be applauded.  Everyone knows that fundamental human rights are universal. That is the tacit assumption of the Declaration.

    To call Kashmir a territorial dispute is to dehumanize it: Ambassador Buch

The nation of Kashmir salutes his commitment and dedication, and pay tribute to his inspirational spirit. Ambassador Buch is undoubtedly, a living encyclopedia on Kashmir.”
